TERMS OF SERVICE

These Terms of Service ("Terms") are a binding agreement between you and BrainRotAI, a small business operated from the Commonwealth of Virginia, USA ("BrainRotAI", "we", "us"), governing the ScenarioRoast / BrainRotAI Discord bot (the "Bot"), the web dashboard at https://www.brainrotai.io (the "Site"), and purchases of Brain Cells (together, the "Service"). You accept these Terms by inviting the Bot to a server, using any Bot command, signing in to the Site, or making a purchase.

• You must be at least 13 years old AND meet the minimum age of digital consent in your country (for example, 16 in parts of the EU). The Service is not directed to children under 13, and we remove under-13 users and delete their data when we become aware of them.
• If you are under 18, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
• A server administrator who invites the Bot represents that they have authority to enable it for that server and accepts these Terms on the server's behalf.

The Service generates AI-powered entertainment inside Discord servers: satirical "roasts", parody impersonations of server members (/ask), AI trading cards (/lore), games, and AI-generated images, with an optional family-friendly mode. The Service uses third-party AI models (Google Gemini and OpenAI) to generate content.

• BrainRotAI is not affiliated with, endorsed by, or sponsored by Discord Inc. Discord's own Terms of Service and Community Guidelines continue to apply to your use of Discord.
• These Terms are solely between you and BrainRotAI. They do not modify Discord's Terms, and if these Terms conflict with Discord's Terms, Discord's Terms control.
• To report a problem, abuse, or a violation of these Terms, email support@brainrotai.io. We review reports and may act on them, including cooperating with Discord Trust & Safety.

• We grant you a limited, revocable, non-exclusive, non-transferable license to use the Bot and Site for personal, non-commercial use within Discord.
• You may not scrape the Service, reverse engineer it, evade rate limits, automate abuse, or resell the Service or its outputs as a dataset or competing service.
• We may modify, suspend, or discontinue any feature at any time, including because Discord or an AI provider changes or revokes API access.

The Service generates roast-style satire. By participating in a server where the Bot is enabled, members acknowledge the humor format — but consent has limits, and the following rules always apply:

• Roasts, impersonations, and cards may target only members of the same server where the Bot is installed. Never people outside the server.
• Any member may opt out at any time with the /roast-optout command. Opting out immediately stops all targeting AND purges that member's stored data. Opted-out members must not be targeted by any feature.
• Prohibited: harassment campaigns or coordinated pile-ons; content attacking protected characteristics (race, ethnicity, religion, sex, sexual orientation, gender identity, disability); any sexual content involving minors; threats, doxxing, or encouragement of self-harm; using the Service for anything illegal.
• You may not use the Service to violate Discord's Community Guidelines, Google's Generative AI Prohibited Use Policy, or OpenAI's Usage Policies.
• We may refuse or filter prompts, remove content, and restrict features per server or per user at our discretion, and may report serious violations to Discord.

• All roasts, impersonations, cards, and images are AI-GENERATED, FICTIONAL, AND SATIRICAL. They are not statements of fact about any person and may be inaccurate, exaggerated, offensive, or entirely made up.
• Impersonation outputs (/ask) are parodies generated from a member's own server messages. They are NOT the member's actual words. You must not present any output as a genuine statement of a real person.
• Outputs are entertainment only — no professional, legal, medical, or financial advice. You are responsible for how you use and share outputs.
• As between you and us, you own the AI outputs you request, subject to the license limits in these Terms and third-party rights. Similar or identical outputs may be generated for other users.

• You grant BrainRotAI a non-exclusive, worldwide, royalty-free license to process your Discord messages, prompts, username, display name, and avatar solely to operate the Service's stated features.
• Likeness consent: by using the Service (or remaining in a server where it is enabled without opting out), you consent to the use of your username, avatar, and message style in AI-generated roasts, parody impersonations, trading cards, and image edits within that server. You can withdraw this consent at any time with /roast-optout, which also purges your stored data.
• Voice cloning is strictly opt-in and self-only: your synthetic voice is created ONLY if you enroll a recording of your own voice via /voice-enroll and confirm the consent prompt. Submitting a recording of anyone else's voice is prohibited, is grounds for immediate termination, and may violate right-of-publicity and fraud laws. Withdraw anytime with /voice-remove.
• You represent that content you submit does not infringe anyone else's rights. We may remove content that does.

• Brain Cells are a limited, revocable license to use paid features. They are NOT money or property, have NO cash value, are non-transferable between users or servers, and cannot be redeemed for cash.
• Brain Cells are purchased per server through one-time Stripe payments. Consumed Brain Cells are non-refundable. Unconsumed balances are non-refundable except for billing errors or where required by law — contact support@brainrotai.io and we will review in good faith.
• We may change pricing, grant amounts, and feature costs, or discontinue Brain Cells, with reasonable notice. If the Service shuts down, unused Brain Cells expire without compensation.
• Brain Cells may not be wagered or used in any gambling mechanic for prizes of value.

• Payments are processed exclusively by Stripe. We never receive or store full card numbers. Your payment is also subject to Stripe's terms and privacy policy (stripe.com/privacy).
• Prices are in USD and may be subject to tax. All sales are final, subject to Section 7's billing-error review.
• Suspected billing errors: contact support@brainrotai.io within 30 days of the charge. Chargeback abuse may result in suspension of the associated server or account.

We respond to copyright infringement notices under the Digital Millennium Copyright Act and terminate repeat infringers. Send notices to support@brainrotai.io with: (1) your signature; (2) identification of the copyrighted work; (3) identification and location of the allegedly infringing material; (4) your contact information; (5) a good-faith statement that the use is unauthorized; and (6) a statement under penalty of perjury that your notice is accurate and you are authorized to act. Counter-notices may be sent to the same address. AI image features may not be used to infringe third-party intellectual property.

The Service depends on Discord (platform APIs), Google Gemini (text generation), OpenAI (image generation), Stripe (payments), and Railway (hosting). We are not responsible for their outages or changes, and the Service may end if a critical provider (such as Discord) revokes access.

• We may suspend or terminate access for violations of these Terms, legal compliance, or Discord enforcement actions — without notice for serious violations.
• You can stop using the Service at any time. /roast-optout purges your personal data; removing the Bot from a server stops collection and triggers deletion of that server's data per the Privacy Policy.
• On termination, your licenses end and Brain Cells expire. Sections 5, 6 (granted licenses), 12–16 survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY. WE SPECIFICALLY DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, APPROPRIATE, OR INOFFENSIVE, OR THAT THIRD-PARTY SERVICES WILL REMAIN AVAILABLE. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAINROTAI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR DAMAGES ARISING FROM AI OUTPUT CONTENT, YOUR RELIANCE ON OUTPUTS, OR THIRD-PARTY SERVICE FAILURES. OUR TOTAL AGGREGATE LIABILITY IS CAPPED AT THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. These limits do not apply to liability that cannot be limited by law, including for gross negligence or willful misconduct.

You will indemnify and hold BrainRotAI harmless from claims arising out of your content or prompts, your misuse of outputs (for example, republishing a parody impersonation as if it were real), your violation of these Terms, or your violation of third-party rights. Server administrators additionally indemnify us for claims arising from enabling the Bot in their server contrary to their community's rules.

• Informal resolution first: before filing any claim, email support@brainrotai.io with a written description of the dispute; the parties will negotiate in good faith for 60 days.
• Any dispute not resolved informally will be settled by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Virginia (or conducted remotely), governed by the Federal Arbitration Act. We will pay arbitration fees above your filing fee for consumer claims.
• Small-claims carve-out: either party may instead bring an individual claim in small-claims court.
• Opt-out right: you may opt out of arbitration by emailing support@brainrotai.io within 30 days of first accepting these Terms, with your Discord user ID and a statement that you opt out of arbitration.
• CLASS ACTION AND JURY TRIAL WAIVER: DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS — NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class waiver is found unenforceable for a claim, that claim (and only that claim) proceeds in court, not the entire arbitration agreement.
• Coordinated mass filings will be batched and resolved in staged proceedings under the AAA's mass-arbitration procedures.

These Terms are governed by the laws of the Commonwealth of Virginia and applicable US federal law, without regard to conflict-of-laws rules. For claims not subject to arbitration, the exclusive venue is the state and federal courts located in Virginia, and you consent to their jurisdiction. If you are a consumer in a jurisdiction with mandatory local protections, those rights are preserved.

• We may update these Terms. Material changes will be announced on the Site with at least 14 days' notice before taking effect; continued use after that is acceptance. Dated versions are kept.
• If part of these Terms is unenforceable, the rest remains in effect. These Terms are the entire agreement about the Service. We may assign these Terms in a business transfer; you may not assign them. We are not liable for delays caused by events beyond our reasonable control.
